Limit of Liability *

Owner hereby agrees that, to the fullest extent permitted by law, Kansali's total liability to Owner for any and all injuries, claims, losses, expenses or damages whatsoever arising out of or in any way related to the project or this Agreement from any cause(s) including but not limited to Kansali's negligence, errors, omissions, strict liability, breach of contract or breach of warranty shall not exceed the total amount of the deposit fee. Owner hereby agrees that to the fullest extent permitted by law, Kansali shall not be liable to Owner for any special, indirect or consequential damages whatsoever, whether caused by Kansali's negligence, errors, omissions, strict liability, breach of contract, breach of warranty or other cause(s) whatsoever, including but not limited to, loss of use of equipment or facility, and loss of profits or revenue.

Services Provided *

Kansali reserves the right to use images from your session for marketing, website use, social media imagery or promotional material. Kansali shall not be be responsible for late arrivals or cancellations. It is the clients responsibility to arrive to the session on time and to arrange transportation to and from the session. The client understands that Kansali is NOT RESPONSIBLE for any lost, stolen, damaged property that belongs to the client. The client also understands that if damage to Kansali's equipment or facilities occurs because of negligence on behalf or relating to the client, that aforementioned client shall be responsible for all damages incurred. At any time, if a Kansali member is threatened or faced with a conflict that disrupts the rendering of services, Kansali reserves the right to discontinue service and there will not be a refund for any monies paid.

Deposit & Payments *

After a consultation for photography services, the client is required to pay a non-refundable deposit of $100 that is to be credited to the final cost of services. Headshot services require a non-refundable deposit of $50 that is to be credited to the final cost of services. The deposit serves as a retainer for services and secures the date of the appointment. The client also agrees to arrive at the session with proper payment ready before the session occurs, or otherwise has made arrangements to pay the balance in full before arrival. Non-payment of deposit amount or regular balances justifies a cancellation by Kansali for the session. In the event you are late, absent, or cancel without proper notice (a week before session) the deposit will not be refunded. You will have one week to reschedule under the same deposit. If it is after one week and you still desire Kansali services, a new deposit for $100.00 will be required. During the consultation for music lessons, scheduling will be finalized. Payment for one month's service is always required in advance. Non-payment of a month's worth of lessons justifies a cancellation by Kansali for the session(s). In the event you are late, absent, or cancel without proper notice (a 24-hour notice) you will have the ability to reschedule within one month of the missed lesson(s). There will be no refund rendered if you fail to reschedule within the allotted time.
